Filorent Car Rental
These General Rental Terms and Conditions (hereinafter, the "Conditions") govern the contractual relationship between Filorent Car Rental, its affiliates or dealers (hereinafter, the "Lessor") and the customer, whether a natural or legal person (hereinafter, the "Customer"), for the rental of vehicles without a driver.
The Conditions constitute an integral and essential part of the rental agreement signed by the Customer (hereinafter, the "Rental Agreement"), together with the Rental Letter, the Vehicle Status Report, the Privacy Policy and related conditions (available at www.filorent.it), and any attachments.
By signing the Rental Agreement, the Customer declares to have read, understood, and fully accepted these Conditions. By accepting the Conditions, the Customer confirms to know and comply with the rules regarding booking and payment, the use and circulation of the vehicle, delivery and return, as well as responsibilities during the rental. The Customer also accepts the provisions on charges, termination clauses, protection of personal data, possible contractual amendments, the applicable law and the competent Court, the language of the contract and its interpretation, as well as the procedures for official communications.
1. DEFINITIONS
For the purposes of these Conditions:
- Vehicle: the rented vehicle, including all equipment, accessories, and documentation
- Rental Period: the period between the vehicle pick-up (check-out) and its return (check-in).
- Authorized Driver: the Customer and any additional driver indicated in and authorized under the Rental Agreement.
- Financial Responsibility: the maximum amount chargeable to the Customer in the event of damage, theft, or fire, as specified in the Rental Agreement and applicable price lists.
- Vehicle Status Report: the document, in paper or electronic form, prepared by Filorent at the time of delivery and/or return of the Vehicle, recording the Vehicle’s condition, any visible damage, fuel level, equipment, accessories, and any other elements relevant to the rental.
2. NATURE OF THE CONTRACT
The Rental Agreement constitutes a lease of movable property without a driver. Nothing in this Agreement shall be construed as a transfer of ownership of the Vehicle or as granting any proprietary or in rem rights therein.
The Customer acquires no rights in the Vehicle other than the right to use it, strictly within the limits and in accordance with the terms set out in these Conditions.
3. CUSTOMER AND DRIVER REQUIREMENTS
The rental is permitted exclusively to individuals who, at the time of pick-up, meet the requirements set out below. The Customer is responsible for the accuracy of the information provided and guarantees that all Authorized Drivers comply with these Conditions.
3.1 AGE AND LICENSE SENIORITY
- Minimum age: the driver must be at least 19 years old.
- License seniority: the driver must have had a driving license for at least 1 year.
- Drivers aged 19–24: permitted only for vehicle groups B / B1 / C and subject to the payment of the “Young Driver” supplement according to the current price list and the provisions of the Contract.
- Drivers aged ≥25: permitted for all available vehicle groups, subject to any further requirements indicated in the Contract.
- Drivers aged 80–85: permitted subject to the payment of the “Senior Driver” supplement according to the current price list and the provisions of the Contract.
Filorent may, depending on the age of the driver and/or the category of the Vehicle, require additional documentation to verify fitness to drive and/or further payment guarantees.
If the driver does not meet the age requirements for the booked Vehicle category, Filorent may, at its sole discretion and subject to availability, offer a lower-category Vehicle at the applicable rate. This shall not entitle the Customer to any compensation or refund.
3.2 DRIVING LICENSE AND DOCUMENTS
The driver must present:
- a valid driving license suitable for the Vehicle category.
- a valid identity document (ID card or passport).
Driving licenses issued in EU/EFTA countries are accepted. Licenses issued outside the EU must, where required by applicable regulations, be accompanied by an International Driving Permit and/or an official translation. Military licenses and/or photocopies are not accepted.
3.3 PAYMENT METHOD AND CARD IN THE DRIVER'S NAME
Payment for the rental and the provision of any required guarantees must be made exclusively using the payment methods accepted by Filorent, as specified in the Rental Agreement and the applicable price list.
In particular:
- The Customer must present a valid physical payment card in the name of the main driver (Mastercard, Visa, or American Express credit cards – Mastercard or Visa debit cards).
- The card must have a sufficient limit (plafond) to cover the rental cost, any additional services, and the required security deposit (Art. 10).
- Cash, cheques, prepaid, or rechargeable cards are not accepted, unless otherwise expressly indicated by Filorent.
- The card must be physically presented. Virtual or digital cards (e.g. digital wallets or app-based cards only) are not accepted.
- The use of debit cards may be subject to the purchase of specific additional coverages (Debit Card Package – see the "INSURANCE COVERAGES" section) and/or to additional conditions, as set out in the Agreement and applicable price lists.
In the absence of a payment method that complies with the above requirements, Filorent may refuse to deliver the Vehicle, without any right to refund or compensation for the Customer.
4. RENTAL DURATION
The rental period starts at the time of vehicle pick-up (check-out) and ends only upon its return - including keys and accessories - at the agreed location, following completion of the vehicle condition inspection (check-in).
Filorent reserves the right, at its sole discretion, to refuse to enter into a Rental Agreement with the Customer, in particular in cases of theft, damage, or at-fault accidents occurring during previous rentals.
For billing purposes, one rental day consists of 24 hours from the time of delivery. Rentals of less than 24 hours are therefore charged as a full day. A grace period of up to 59 minutes is allowed beyond the return time indicated in the Agreement; thereafter, an additional charge equivalent to a full rental day, or as provided by the applicable rates, will apply.
The Customer must return the Vehicle during office opening hours, to designated staff and at the agreed location.
The maximum rental duration is 30 days; beyond this period, a new reservation is required.
The Customer remains responsible for the Vehicle until the check-in procedure has been completed.
4.1 VEHICLE RETURN BEFORE THE AGREED DATE
If the Customer returns the Vehicle and any additional options prior to the agreed date and time, and the conditions of the agreed rate are no longer met, such rate shall not be guaranteed and may be subject to adjustment, which may result in an increase in the total rental cost.
No refund shall be provided for unused rental days.
4.2 VEHICLE RETURN AFTER THE AGREED DATE OR FAILURE TO RETURN
If the Customer wishes to extend the rental, they must contact Filorent (including via e-mail, SMS or other channels indicated by Filorent). Any extension is subject to availability and may involve:
- Application of the current rate for the additional days.
- Payment for any extra kilometers driven beyond those included in the agreed rate.
- Updating the pre-authorization/security deposit.
- A "one-way" supplement if the Vehicle is returned to a rental office other than the one agreed upon.
- A requirement to sign a new Contract and/or replace the Vehicle.
If the Customer fails to request an extension and/or fails to return the Vehicle within the agreed timeframe, Filorent may, at its discretion:
- Automatically extend the rental and charge for extra days and kilometers according to the current Standard rate.
- Immediately terminate the Contract by right pursuant to Art. 14.
- Cause the Customer to forfeit any limitations of liability and purchased coverages, within the limits permitted by law.
- Initiate vehicle recovery procedures and, if necessary, notify the competent authorities.
The following costs shall remain the responsibility of the Customer, by way of example:
- Recovery and transport costs;
- Loss of use/technical downtime and loss of revenue.
- Reasonable management and administrative costs.
- Any costs owed to third parties.
5. THE VEHICLE
The rented Vehicle remains the exclusive property of Filorent, or its authorized entities.
The Vehicle is delivered to the Customer in roadworthy condition, clean, and equipped with all items required by applicable law, as well as with the accessories specified in the Rental Agreement and recorded in the Vehicle Status Report.
The Customer acknowledges and accepts that:
- The Vehicle may show minor signs of wear and tear consistent with its age and mileage.
- The assigned Vehicle model may differ from the one booked, provided that the booked category is respected.
- Any images or descriptions on the website or in promotional/informational materials are for reference only.
The Customer undertakes to safeguard the Vehicle, keys, onboard documents, accessories, and equipment with the utmost care and shall be held liable for any loss, damage, or theft thereof.
6. VEHICLE PICK-UP (check-out)
At the time of pick-up, the Customer is required to check the Vehicle and immediately report any discrepancies with the condition recorded in the Vehicle Status Report.
If the Customer does not report any issues at pick-up, the Vehicle’s condition is considered accepted.
7. USE OF THE VEHICLE
The Customer acts as the custodian of the Vehicle and acknowledges that they hold no property rights (in rem) over it and therefore cannot sell, transfer, or otherwise dispose of it. The Customer undertakes to:
a) Drive and safeguard the Vehicle and its accessories with care, diligence, and in full compliance with all applicable laws, regulations, and any instructions, warnings, or precautions provided by Filorent.
b) Pay any fines or penalties issued during the rental period and reimburse Filorent for any expenses, including legal costs, arising from or in connection with the rental.
c) Pay any parking fees or motorway tolls incurred during the rental period.
d) Indemnify and hold Filorent harmless from any claims by third parties for damages to persons or property transported in or otherwise associated with the Vehicle.
The Customer further undertakes to use and safeguard the Vehicle with the highest level of care, prudence, and skill, in accordance with its intended use, Filorent’s instructions, applicable laws, and the Highway Code. The Customer acknowledges that any improper use, even if not expressly prohibited, or insufficient care may be considered by Filorent as misuse of the Vehicle.
It is strictly prohibited to:
- Allow the Vehicle to be used by anyone not listed as an Authorized Driver
- Use the Vehicle for illegal activities or purposes contrary to law or public order
- Sub-rent, lend or otherwise transfer the Vehicle to third parties
- Refuel the vehicle with unsuitable fuel
- Transport fuel, flammable, explosive, or corrosive materials
- Transport animals, substances, or any items that, due to their condition or odor, may damage the vehicle or delay its re-renting (in such cases, extraordinary cleaning fees as indicated in the Filorent Price Lists will be charged to the Customer)
- Perform any repairs on the Vehicle without the written consent of Filorent
- Use the Vehicle under the influence of alcohol, drugs, or any substances that may impair driving ability
- Use the Vehicle in an imprudent, negligent manner, or contrary to the standard rules of care
- Use the Vehicle for competitions, races, speed tests, off-roading, towing, or carrying unauthorized loads.
Violation of any of the above obligations will result in the automatic forfeiture of all coverages or limitations of liability, with the Customer being fully responsible for all direct and indirect damages suffered by Filorent.
Any interventions or repairs carried out on the Vehicle by the Customer without Filorent’s authorization will not be reimbursed under any circumstances. In the event the Customer requests a replacement Vehicle, Filorent reserves the right, at its sole discretion and based on vehicle availability at the relevant time and location, to decide whether to provide a replacement.
The Customer also undertakes to:
- Ensure that the Vehicle is properly locked, verifying that all windows, the sunroof, and the hood are closed, and to safeguard the keys with due care.
- Immediately stop the Vehicle if any malfunction is detected that could compromise safety, or in the case of any other defect, and to promptly notify Filorent.
8. TERRITORIAL RESTRICTIONS
Unless otherwise indicated in the Rental Agreement, Filorent Vehicles may be driven within the member states of the European Union, as well as in the United Kingdom, Switzerland, Liechtenstein, Vatican City, Republic of San Marino, Andorra, and the Principality of Monaco.
Vehicles cannot circulate in countries outside the European Union other than those listed above, nor in Estonia, Latvia, and Lithuania.
The boarding of Vehicles on ferries is permitted; however, any damage occurring during maritime transport remains the responsibility of the Customer, regardless of any coverages purchased.
Customers intending to drive the Vehicle outside of Italy must notify Filorent in advance to obtain the original registration document, which must be presented to the competent authorities in the event of border controls.
Failure to comply with these territorial restrictions will result in the forfeiture of all coverages and the Customer being charged for all costs, damages, and expenses incurred by Filorent.
These restrictions are established to ensure the safety of the Vehicle and to maintain compliance with insurance conditions.
9. LIABILITY FOR DAMAGE, THEFT, AND FIRE
The Customer is responsible for the Vehicle for the entire duration of the Rental Period, from the moment of pick-up until its complete return and verification by Filorent.
In the event of damage, theft, fire, vandalism, or any accident - including accidental events - the Customer is required to:
- Immediately inform Filorent
- Notify the competent authorities without delay, where required
- Complete all requested documentation fully and truthfully
- Cooperate actively and promptly in the management of the claim
Failure to notify, providing incomplete or late information, or refusal/lack of cooperation by the Customer will result in:
- Forfeiture of any purchased coverages
- Full liability for all damages, restoration costs, administrative, and management expense
- Potential application of penalties as set out in the current price lists
If multiple separate damaging events occur, the Customer shall be held responsible for each event individually.
Any applicable penalties or deductibles (financial responsibility), based on the supplements selected by the Customer, are detailed in the following table:

13. COVERAGE AND LIMITATIONS OF LIABILITY
Any insurance coverages and/or limitations of liability (including, but not limited to, reductions of Financial Responsibility for damage, theft, or fire, and glass/tyre coverage) are valid only if:
- They are explicitly stated in the Rental Agreement;
- They have been fully paid for;
- No causes for forfeiture, as set out in these Conditions, have occurred.
The Financial Responsibility (deductible) and any applicable penalties are those specified in the Rental Agreement and the current price lists.

- Lack of cooperation by the Customer in managing the incident
13.2 OMISSION OF ACCIDENTS AND DOCUMENTATION OF OPERATIONAL PENALTIES
In the event of an accident, the Customer must record the names and addresses of all parties and witnesses and provide Filorent with all relevant information. If the accident involves a third party, the Customer must complete and sign the CID form (Amicable Accident Report) and deliver it to Filorent within 24 hours, or by the end of the rental period if it ends sooner.
Even if no accident has occurred, the Customer must declare this upon returning the Vehicle to Filorent, to allow Filorent to protect its rights against fraud or unfounded claims.
Notwithstanding the provisions of Article 9, if the Customer fails to report accidents or damages, or fails to provide the requested documentation (including, but not limited to, the CID/CAI form, accident reports, photographs, or authorities’ reports), Filorent may apply an operational penalty/deductible of €500.00 + VAT, without prejudice to any greater damages or the right to charge the full cost of the damage.
14. SECURITY DEPOSIT
At the beginning of the rental, a security deposit is always required, either through pre-authorization or a charge, as a guarantee for all obligations of the Customer.
The deposit is pre-authorized on the main driver’s credit or debit card. The pre-authorization may remain until it expires according to the card issuer’s processing times and, in any case, will automatically expire no later than 30 days from the time the hold was applied.
If pre-authorization is not possible, Filorent may request a direct charge of the deposit. In such cases, the refund will normally be processed within 10 working days after the end of the rental via bank transfer (the IBAN may be requested at the rental desk).
The deposit may be used, in whole or in part, for the payment of amounts owed by the Customer.

15. VEHICLE RETURN POLICY AND RETURN TIME
The Vehicle must be returned by the date and time specified in the Rental Agreement, or within a maximum grace period of 59 minutes beyond the agreed time. After this grace period, an additional charge equal to a full rental day, or the amount specified in the current rates, will apply, without prejudice to compensation for any further damages incurred by Filorent. The Customer remains responsible for the Vehicle until the return and verification (check-in) process is fully completed.
15.1 VEHICLE CONDITION UPON RETURN
The Vehicle must be returned in the same condition as it was delivered, except for normal wear and tear. Upon return, the Vehicle will be inspected by Filorent staff. Any damages that were not reported or declared will be charged to the Customer in accordance with these Conditions and the Damage Table available on the official website www.filorent.it, in addition to the terms of the Rental Agreement and the current price lists.
15.2 FUEL
Unless otherwise agreed in writing, the Vehicle must be returned with the same fuel level recorded in the Vehicle Status Report at the time of pick-up. If the Vehicle is returned with a lower fuel level:
- A refueling service fee of €35,00 will be charged;
- In addition to the cost of the missing fuel, calculated according to current rates.
The Rental Agreement specifies the fuel level at the start of the rental and the level required upon return (normally a full tank). The Customer may choose to refuel the Vehicle before returning it or pay the refueling cost directly at the return location, based on regional fuel prices per liter, plus the €35,00 service fee.
Any fuel remaining in excess of the amount present at delivery will not be reimbursed to the Customer.
15.3 CLEANING
The Vehicle must be returned in the same level of cleanliness as it was delivered. If the Vehicle requires extraordinary cleaning, Filorent may charge a €30,00 fee, in accordance with the current price list.
15.4 ACCESSORIES AND EQUIPMENT
All accessories and equipment provided with the Vehicle (e.g., snow chains, child seats, charging cables, documentation) must be returned complete and in good condition. In case of loss or damage, the Customer will be charged the full cost of replacement or repair, according to the current price list.
15.5 EARLY RETURN
If the Vehicle is returned earlier than the date specified in the Rental Agreement, no refund will be provided for unused days, unless otherwise agreed in writing with Filorent.
15.6 DOCUMENTATION IN CASE OF ACCIDENT, DAMAGE, OR THEFT
In the event of an accident, theft, or damage, the Customer must provide a complete and truthful report of the incident upon return, along with all requested documentation.
If the Customer:
- Fails to report accidents or damages, or
- Fails to provide the requested documentation related to damages or theft,
Filorent may apply a deductible charge of €500.00 + VAT, without prejudice to any greater damages and in accordance with the provisions of these Conditions.
16. ADDITIONAL CHARGES
By providing credit card details, the Customer authorizes Filorent to charge all fees due in connection with the rental and acknowledges that the credit card may be charged for any amounts found to be payable even after the Rental Agreement has ended.
Filorent is expressly authorized to charge the Customer, even after the Vehicle has been returned, for all amounts due for any reason, including but not limited to:
- Damages identified during subsequent inspections
- Restoration costs, repairs, or technical downtime of the Vehicle
- Fines, administrative penalties, tolls, parking fees, and ZTL (Restricted Traffic Zone) charges (in this case the cost for the delayed charge will be eur 25,00)
- Administrative and file management fees
- Contractual penalties as provided in the current price lists
These charges may be processed as soon as Filorent becomes aware of them, and in any case, even after some time has passed since the Vehicle’s return, within the limits permitted by law.
The Customer hereby waives the right to raise objections or disputes solely on the basis that the charge was made after the rental period ended.
The pre-authorization for such charges and reimbursement of expenses is expressly stated on page 2 of the Rental Agreement, Art. 4(c).
16.1 DELAYED CHARGE FOR FINES, ADMINISTRATIVE PENALTIES, TOOLS, PARKING, ZTL
The Customer will be notified of any traffic violations, Highway Code infringements, or unpaid motorway tolls and/or parking fines incurred during the rental period. In addition, an administrative handling fee of €25,00 will be charged to the Customer’s credit card for each individual fine, unpaid toll, or parking ticket.
Traffic violations involving rental vehicles often require more time to process than those involving privately owned vehicles. The Customer may not receive prior notice, because Filorent, as the registered owner of the Vehicle, first receives the fine and then informs the authorities of the actual driver.
The deadline to pay the fine begins once the notification is issued to the driver.
17. BUSINESS CUSTOMERS (B2B)
Corporate or Professional Customers
- The Customer signing the Contract confirms that they have the necessary powers of representation.
- The Customer is jointly and severally liable for all obligations arising from the Contract, including those resulting from the acts or omissions of Authorized Drivers.
- The Customer remains fully responsible even if the Vehicle is used by employees, collaborators, consultants, or any other individuals associated with the organization.
The Business Customer shall indemnify and hold Filorent harmless from any claims, demands, or legal actions brought by third parties relating to the use of the Vehicle during the Rental Period.
18. TERMINATION OF THE CONTRACT
Any violation, even partial, of these Conditions, including non-compliant use of the Vehicle or failure to fulfill the Customer’s obligations, entitles Filorent to immediately terminate the Contract pursuant to Art. 1456 of the Italian Civil Code, without prejudice to the right to claim compensation for any additional damages.
Termination does not affect Filorent’s right to recover all amounts due, including through subsequent charges to the payment methods provided by the Customer.
Specifically, any violation of these Conditions gives Filorent the right to immediate Contract termination, without limiting its right to seek damages.
19. RESERVATIONS, CANCELLATIONS AND NO-SHOWS
Unless different conditions are specified during the booking phase or in the Rental Agreement:
- the booking may be cancelled up to 24 hours before the scheduled pick-up date and time without incurring any costs.
- the Vehicle is guaranteed for 2 hours after the scheduled pick-up time and, in any case, no later than the office closing time (plus any extension in case of purchased "out-of-hour" extra services);
- should the Customer notify a delay in advance, Filorent may, subject to availability, hold the Vehicle until the newly communicated time.
In the event of a no-show or failure to comply with the pick-up conditions, Filorent reserves the right to cancel the booking and apply the amounts provided for in the price lists and/or the conditions of the booked rate.
20. COMPLAINTS AND INFORMATION REQUESTS
The Customer has the right to submit complaints regarding the rental service directly to Filorent using the contact details provided in the Rental Agreement. Each complaint will be carefully reviewed and handled in accordance with applicable regulations. The Customer is encouraged to provide all relevant information to allow Filorent to properly assess the situation and propose potential solutions.
Filorent also offers a dedicated assistance service for any needs related to the Vehicle rental. The Customer may contact this service via email (info@filorent.it) or through other channels indicated in the Rental Agreement or on the official website.
Filorent staff will provide prompt support for questions regarding rental conditions, Vehicle usage, available accessories, or any other aspect of the service, with the aim of ensuring a clear, safe, and smooth rental experience.
21. APPLICABLE LAW
The Contract is governed by Italian law.
Any dispute arising from or in connection with this Contract shall fall under the exclusive jurisdiction of the Court of the location of Filorent’s registered office, without prejudice to the protections provided by the Consumer Code for Customers acting as consumers.
22. CUSTOMER DOMICILE AND COMMUNICATIONS
The Customer declares that they elect their domicile at the address provided to Filorent, as indicated in the Rental Agreement. Unless otherwise expressly specified by the Customer, all contractual communications will be sent to the email address provided by the Customer.
23. FINAL PROVISIONS
Any Any disputes regarding the rental, the condition of the Vehicle, or the charges applied must be communicated in writing to Filorent no later than 7 days after the return of the Vehicle or receipt of the relevant charge. After this period, any claim will be considered definitively waived.
If one or more clauses of these Conditions are found to be invalid or ineffective, in whole or in part, the remaining provisions shall remain fully valid and effective.
These Conditions supersede any previous version and are subject to periodic updates. The most recent and current version is the one published on Filorent’s official website.
